Police: Gainesville man raped friend while they watched TV together

A 22-year-old Gainesville man was arrested and charged with felony sexual assault after police say he raped a 20-year-old acquaintance while they were watching television together.

The woman, also of Gainesville, still had visible injuries Thursday when she contacted police to report the rape, which had occurred four days prior, police say.

Joshua Banks had never been involved in a romantic relationship with the victim prior to the attack, police reported. The two were watching television when Banks began to physically struggle with the young woman. During the struggle, the victim told Banks numerous times she did not want any kind of sexual contact with him, according to the arrest report from the Gainesville Police Department.

Police apprehended Banks on Sunday, and he admitted to having intercourse with the victim on June 23 and to bringing and using a condom, police reported.

A delay in reporting by sexual assault victims is not unusual, GPD spokesman Officer Ben Tobias said. While in this case there was still some evidence of physical injury visible on the victim four days later, Tobias stressed the importance of early reporting.

“Victims are encouraged to contact law enforcement or an advocate as soon as they can after an attack to get the investigative process rolling,” Tobias said. “First and foremost, don’t take a shower, don’t wash the clothes or do anything that may potentially destroy evidence of the crime. We realize that reporting a sexual battery is sometimes a difficult decision, but they don’t have to be silent victims.”

After his arrest, Banks was booked into the Alachua County jail, where he was released Monday morning on a $25,000 bond.
